1. Agreement to Terms

Welcome to MyDreamverse. These Terms of Service ("Terms") govern your access to and use of the MyDreamverse website, services, and applications (collectively, the "Service"). MyDreamverse is an AI-powered image transformation service that allows users to transform their photos into various artistic styles. Our Service uses artificial intelligence and machine learning technologies to generate stylized versions of user-uploaded images.

3. User Accounts and Credits

3.1. To use certain features of the Service, you may be required to create an account and purchase credits.

3.2. Credits are non-refundable once purchased. We do not provide refunds for any unused credits, regardless of the circumstances.

3.3. Credits may expire after a certain period as specified at the time of purchase. It is your responsibility to use your credits before they expire.

3.4. We reserve the right to modify the pricing of credits or the number of credits required for specific features at any time without prior notice.

4. User Content and Licensing

4.1. By uploading images to our Service, you retain all rights to your original content. However, you grant us a non-exclusive, worldwide, royalty-free license to use, reproduce, modify, and display your content solely for the purpose of providing the Service to you.

4.2. You are solely responsible for the images you upload to our Service. You must not upload any content that infringes upon the intellectual property rights of others or violates any applicable laws.

4.3. You own the rights to the transformed images generated by our Service based on your uploaded content. You may use these images for personal or commercial purposes, subject to the limitations in Section 5.

5. Usage Restrictions and Disclaimers

5.1. While you may use the transformed images for commercial purposes, we make no representations or warranties regarding the suitability of the images for any particular purpose. You use the images at your own risk.

5.2. We are not responsible for any legal issues that may arise from your use of the transformed images, including but not limited to copyright infringement, trademark violations, or other intellectual property disputes.

5.3. You must not use our Service to generate content that is illegal, harmful, threatening, abusive, harassing, tortious, defamatory, vulgar, obscene, libelous, invasive of another's privacy, hateful, or racially, ethnically, or otherwise objectionable.

5.4. We reserve the right to remove any content that violates these Terms or that we find objectionable for any reason, without prior notice.

6. Service Availability and Modifications

6.1. We strive to provide a reliable service, but we do not guarantee that the Service will be available at all times or that it will be error-free.

6.2. We reserve the right to modify, suspend, or discontinue the Service, temporarily or permanently, at any time without notice. We will not be liable to you or any third party for any modification, suspension, or discontinuation of the Service.

6.3. We may update these Terms from time to time. Your continued use of the Service after any changes to the Terms constitutes your acceptance of the revised Terms.

7. Limitation of Liability

7.1. To the maximum extent permitted by law, in no event shall MyDreamverse, its affiliates, officers, directors, employees, or agents be liable for any indirect, punitive, incidental, special, consequential, or exemplary damages, including without limitation damages for loss of profits, goodwill, use, data, or other intangible losses, that result from the use of, or inability to use, the Service.

7.2. In no event will our total liability to you for all damages, losses, or causes of action exceed the amount you have paid us in the last six (6) months, or, if greater, one hundred dollars ($100).

8. Indemnification

You agree to indemnify, defend, and hold harmless MyDreamverse, its affiliates, officers, directors, employees, and agents from and against any and all claims, liabilities, damages, losses, costs, expenses, or fees (including reasonable attorneys' fees) that arise from or relate to your use or misuse of the Service, violation of these Terms, or violation of any rights of a third party.

9. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which MyDreamverse is established, without regard to its conflict of law provisions. You agree to submit to the personal and exclusive jurisdiction of the courts located within that jurisdiction.
